Terms of Service

These Terms of Service outline the conditions and terms to the use of Ticketly Services that you agree to follow upon use of Ticketly Services

Please read these Terms of Service, referred to as "terms" or "terms of service", carefully before use of Ticketly Services ("Ticketly", "the service", "we", "our" or "us"), including Ticketly Bot, Web Dashboard and all releated services operated by Ticketly. By accessing or using Ticketly, you agree to these terms.

Privacy

For functional use of the service we process your personal information in accordance with Australian Privacy Act 1988 and Australian Privacy Principles. Please refer to our Privacy Policy for further information on how we collect, use and store your information

User Guidelines

In using the service, you agree to comply with the following guidelines


  1. 1. Do not attempt or make actions that may dirupt, abuse or cause damanage to Ticketly
  2. 2. Ensure you are using the service in accordance with the laws of your jurisdiction and Australia
  3. 3. Do not make attempt to access information or parts of the service you may not be authorized to access
  4. 4. Do not interfere with, disrupt, or create an excessive burden on the serivce, the networks or any related services
  5. 5. Do not bypass or attempt to bypass measures designed to restrict access to any part of the service
  6. 6. Do not utilize the service to store or hold adult content, including but not limited to images and videos
  7. 7. Ensure you are upholding Discord Terms of Service and Discord Community Guidelines

Purchases

    All purchases are governed under Australian Consumer Law

  1. 1. You must have the legal right and authorization to use the payment method provided for any purchase
  2. 2. Refund requests are assessed on a case-by-case basis. Nothing in these Terms limits your rights under Australian Consumer Law
  3. 3. We reserve the right to suspend, cancel, or refund purchases where necessary for fraud prevention, abuse, Terms of Service violations, payment disputes, service discontinuation, or other legitimate operational reasons
  4. 4. Breaches of these Terms may affect eligibility for discretionary refunds under Australian Consumer Law

Right to Cancel

You may stop using Ticketly Services or remove the Ticketly bot from your server at any time. Removal of Ticketly may result in the deletion of guild-related data in accordance with our Privacy Policy


Upon removal of Ticketly from a server, access to server-specific functionality, dashboards, ticket systems, and related stored data may be removed or become inaccessible. Data handling following termination is governed by our Privacy Policy


Premium features are linked to your individual Ticketly account used to access the Ticketly web dashboard. Unless otherwise terminated in accordance with these Terms, premium access will remain available for the remainder of the active subscription period following removal of Ticketly from an individual server


Nothing in this section limits rights available under Australian Consumer Law

Termination

Ticketly reserves the right to suspend, restrict, or terminate access to some or all Ticketly Services where reasonably necessary, including but not limited to breaches of these Terms, fraudulent or unauthorized activity, abuse or misuse of Ticketly Services, security concerns, violations of Discord Terms of Service or Developer Policies, or operational or legal requirements


Where reasonable, Ticketly may provide notice prior to suspension or termination, however immediate action may be taken where necessary to protect Ticketly Services, users, or third parties


Upon termination, access to Ticketly Services, premium features, dashboards, or related functionality may be removed. Data handling following termination is governed by our Privacy Policy


Nothing in this section limits rights available under Australian Consumer Law

Governing Law and Jurisdiction

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles. You agree that any disputes, claims, or legal proceedings arising from or relating to Ticketly Services or these Terms will be subject to the exclusive jurisdiction of the courts of Victoria, Australia

Indemnity

You agree to indemnify, defend, and hold Ticketly harmless from liabilities, claims, damages, losses, costs, and reasonable expenses (including legal fees) arising from or related to:

  • your breach of these Terms
  • misuse or abuse of Ticketly Services
  • violation of applicable laws or third-party rights; or
  • content, actions, or activities carried out through your use of Ticiketly Services

This indemnity applies only to the extent permitted by applicable law and does not limit rights available under Australian Consumer Law

Limited Liability

Ticketly Services are provided on an “as available" and “as is” basis. While we take reasonable care in providing Ticketly Services, we do not guarantee uninterrupted availability, accuracy, reliability, security, or that the service will be error-free


To the maximum extent permitted by applicable law, Ticketly will not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to, loss of data, loss of profits, business interruption, loss of server functionality, or damages resulting from service interruptions, Discord outages, API limitations, unauthorized access, or technical failures


Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under Australian Consumer Law or other applicable laws

Consumer Rights

Nothing in these Terms excludes, restricts, or modifies any guarantees, rights, or remedies available under Australian Consumer Law or other applicable legislation that cannot lawfully be excluded. Where required by law, users may be entitled to remedies including refunds or compensation.

Ticketly reserves the right to update these Terms of Service at any time. Continued use of Ticketly services following updates constitutes acceptance of the revised terms.
